Position Purpose: Oversees, develops, implements, and maintains a comprehensive privacy program that ensures the confidentiality, integrity, and availability of protected health information (PHI) and other non-public individual data. Collaborate with various departments and stakeholders to foster a culture of privacy and ensure compliance with all applicable laws and regulations. Ensures the responsible use and protection of sensitive information, safeguarding the company's reputation and fostering trust with members and the public.. Establishes and enforces privacy policies, procedures, and guidelines in alignment with organizational goals and regulatory requirements.. Ensures that the Privacy program develops and maintains key controls, elements and functions set forth in applicable regulatory and enforcement guidance.. Identifies areas of privacy vulnerabilities and risk areas and develop preventive, detective and corrective controls and provides general guidance for how to avoid or handle similar situations in the future.. Oversee and manages privacy incidents and breaches, including investigation, reporting, and remediation.. Collaborate with IT, security teams and other operational areas to ensure the secure handling and storage of PHI and other sensitive data.. Partner with relevant stakeholders to manage and respond to regulatory inquiries, government investigations, administrative actions and any other regulatory requests related to Privacy issues or concerns.. Counsel internal business partners on a wide range of privacy matters, including permissible data uses and the application of privacy laws and regulatory guidance to current and new business processes.. Monitors and evaluates the effectiveness of the privacy program and make recommendations for improvement.. Manages and develops direct reports who include other management or supervisory personnel and/or exempt individual contributors.. Implement role-based access controls to limit access to member information based on job responsibilities and "minimum necessary" requirements.. Maintains current knowledge of applicable privacy laws and regulations, including but not limited to HIPAA, CCPA, NAIC Model laws, TCPA and state-specific requirements.. Assist with the process for analyzing and implementing regulatory changes within the Privacy area.. Ensures organizational compliance with all applicable privacy laws and regulations.. Develops and delivers privacy training and awareness programs for employees and business associates.. Monitors and audits compliance with privacy policies and procedures.. Collaborates with legal counsel on privacy-related matters.. Collaborates with human resources to ensure compliance with privacy policies and apply necessary disciplinary actions to employees and business associates who fail to comply.. Establishes and maintains a privacy governance framework that includes policies, procedures, and standards for data handling and protection.. Develops and implements data retention and disposal policies in accordance with legal and regulatory requirements.. Oversee privacy impact assessments (PIAs) for new projects and initiatives.. Advises senior management on privacy-related risks and opportunities.. Promotes a culture of privacy within the organization.. Ensures the organization collects and retains only the minimum necessary amount of member information required for treatment, payment, and healthcare operations.. Develops and implements policies and procedures for the secure and compliant management of health records and other sensitive information.. Ensures compliance with record retention and disposal requirements.. Collaborates with information technology and other departments to ensure the accuracy and integrity of records.. Monitors and audits compliance with records management policies and procedures.. Education/Experience:. Bachelor’s degree in healthcare administration, Information Technology, Law, or a related field required.. Master’s degree in healthcare administration, Information Technology, law, or a related field preferred.. 10+ years privacy-related role in the healthcare industry required.. Deep understanding of privacy laws and regulations, including HIPAA, CCPA, TCPA, and NAIC Data Security model law required.. Experience with privacy risk assessments, . incident response. , and breach management required.. Strong knowledge of privacy best practices and industry standards required.. Licenses/Certifications: . Certified Information Privacy Professional (CIPP), Certified Healthcare Privacy and Security (CHPS), or Healthcare Privacy Compliance Professional (HPCP). Upon Hire required.. Pay Range: $185,200.00 - $352,700.00 per year.
